TERMS OF USE
Overview
These terms of use ("Terms") apply to ordering via the ordering system ("Platform," "Service") online, including the website for mobile, desktop, and mobile applications of Banh Mi XO ("Seller"). This service is operated by Banh Mi XO AS, Org.no: 924 060 964, Address: Olav Vs gate 4, 0161 Oslo.
The Seller may be referred to as "we" or "parties":
These terms apply to all customers or anyone accessing ("User," "Buyer") our service application platforms.
Applies to both account holders and users without an account.
Please carefully read our service terms before using our service.
By accepting the Terms, you are bound by them and agree to comply with those provisions. If you do not agree, please do not use our service.
Apart from the Terms of Use, we provide privacy policies and how we store and process your personal data.
Ordering
By placing an order, you enter into a valid agreement between you and the Seller. A party is not bound by the agreement if there is a typographical error in the Seller's price quotation within the application or webshop, or as per the user's order, and the other party recognizes or should have recognized that it was such an error.
The buyer is responsible for orders placed with inaccurate information.
Selecting the wrong restaurant to order from or ordering the wrong table.
Inaccurate orders compared to what the user expects regarding items, quantities, incorrect time, or date of order.
Orders placed unintentionally by touching order functions on our service platform while it is active.
Account Registration
To place orders, you need to register an account or place an order as a guest.
In the case of registering a membership account, this account can be used to log in to all display formats of the ordering platform on mobile, desktop, or the application.
You must provide accurate information when registering an account and be responsible for the status of your account's activity and account login security, including username and password.
You must be at least 16 years old to register an account on our ordering system.
If there are any unlawful actions or unauthorized use of your account, please report it to us to take measures to protect your account.
Service/Product Prices
The displayed product/service prices on the ordering platform include VAT. Users must pay the product's selling price and service fees, if any, for incurred taxes, delivery fees (transportation, delivery, etc.), payment fees for third parties, or incurred services (packaging, payment fees, etc.).
Additionally, the seller's price policy displayed at the time of the buyer's purchase, including individual components in the total selling price. The seller may change product and service prices on the ordering system according to the seller's price policy.
Payment
You must adhere to our payment policies on our ordering platform/system.
After completing payment for an order, you can register and receive a purchase receipt or contact us to receive the receipt through your preferred methods, such as printing it out or electronic billing. You can also register to receive invoices through your email via our ordering system.
Payment via credit or debit card may involve a reservation subject to your bank's policies.
Users cannot withdraw purchases of damaged goods or goods that, by nature, cannot be returned. The prepaid amount will be debited when the Seller accepts delivery.
Delivery
Delivery will occur after a successful order placement. The delivery time will be as indicated at the time the buyer makes a purchase on our platform. Users can choose delivery time slots from the delivery time lists we display.
If there is a reasonable delay in delivery, it will be implemented by the Seller.
In cases of unreasonable delays or late delivery not compliant with the terms, the buyer has the right to proceed with the order or terminate the transaction and request a refund for that order. This requires direct contact with the Seller to proceed with the termination.
For specific cases such as purchasing alcohol and alcoholic components.
The buyer and seller must comply with the existing legal laws of the country.
The seller reserves the right to refuse service if the buyer violates the government's laws regarding the buyer's age or the purchasing time or in cases of suspicion where the buyer cannot present clear identification or the buyer is intoxicated.
Cancellation Rights
The buyer has the right to cancel a purchase transaction if they find that the items in the order were not delivered as described by the seller when ordering. Cancellation must be agreed upon by the parties and have specific evidence, or the items returned must be in an unchanged state, intact packaging, or with unbroken seals.
For products prone to rapid natural damage, such as food, drinks, or products with a short shelf life, they cannot be returned or handled differently according to current law.
To execute cancellations, please contact the Seller to agree on the order cancellation, return of goods, and refund.
Intellectual Property
All data used in the Seller's ordering system is the intellectual property of the Seller, including data such as logos, brand names, trademarks, images, text content, etc.
Any copying, alteration, or misuse for purposes other than intended is strictly prohibited.
Service Abuse
Adherence to these Terms and the current laws of the country is your responsibility. Especially, there will be no reimbursement for damages if you violate the legal terms related to age for purchasing alcohol or purchasing time, or your identity status when purchasing.
The user bears legal responsibility if they abuse or misapply our service or ordering platform.
Final Terms
The Seller reserves the right to modify the service's terms at any time without informing the user. However, we will strive to notify users of any major changes to the service.
Continued use of the service after changes to the terms implies acceptance of the modified terms.
If any part of these terms is deemed unlawful or unenforceable, that part will be severed, and the remaining provisions shall remain in effect.
